1. Acceptance of Terms
By accessing or using Texas CBE™ ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, please discontinue use immediately.
2. Service Description
Texas CBE™ is an online educational platform designed to help students prepare for Texas Credit by Exam (CBE) tests administered by UT High School (UTHS). The Service provides practice questions aligned with Texas Essential Knowledge and Skills (TEKS) standards, mock examinations, AI-powered explanations, and progress tracking tools.
Important: Texas CBE™ is an independent test preparation service and is not affiliated with, endorsed by, or sponsored by the University of Texas at Austin, UT High School (UTHS), the Texas Education Agency (TEA), or any official Texas state education body.
3. Eligibility
Minimum age — 13. The Service is intended for users 13 years of age or older. We do not knowingly create accounts for, or collect personal information from, children under 13. The signup form requires you to confirm that you are at least 13. If we become aware that an account belongs to a child under 13, we will delete it and any associated personal information promptly.
Parents of children under 13. If you are a parent or legal guardian who wants to use the Service on behalf of a child under 13, please create the account in your own name and supervise your child's use directly. We do not currently provide a verifiable parental-consent flow under COPPA §312.5.
Minors 13–17. Users under the age of 18 must have a parent or legal guardian's permission to use the Service and to make any purchases. By creating an account or making a purchase as a minor, you represent that you have such permission.
By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate.
3a. Geographic Restriction (United States Only)
Texas CBE™ is offered exclusively to users physically located in the United States (including the District of Columbia and the U.S. territories of Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands). The Service is not directed to, and is not intended for use by, residents of any other country, including but not limited to Canada, Mexico, the European Economic Area (EEA), the United Kingdom, Switzerland, the People's Republic of China, the Russian Federation, or any other jurisdiction outside the United States.
By accessing or using the Service, you represent and warrant that:
- You are physically located in the United States or a U.S. territory listed above;
- You are not subject to the General Data Protection Regulation (EU) 2016/679 ("GDPR"), the UK GDPR, the UK Data Protection Act 2018, the Swiss Federal Act on Data Protection, the Brazilian LGPD, China's PIPL, or any other foreign data-protection or consumer-protection regime that would impose obligations on us beyond U.S. federal and state law; and
- You are not a resident of any country, region, or jurisdiction subject to comprehensive U.S. economic sanctions, including but not limited to those identified by the Office of Foreign Assets Control (OFAC).
We employ commercially reasonable technical measures — including IP-based geolocation and timezone-based client-side checks — to enforce this restriction. Visitors from non-U.S. jurisdictions are served an HTTP 451 ("Unavailable For Legal Reasons") response and are not permitted to register or use the Service.
Use of a VPN, proxy, Tor exit node, or any other circumvention method to access the Service from a non-permitted jurisdiction is a material violation of these Terms and may result in: (i) immediate suspension or termination of your account without refund; (ii) revocation of any purchased access; and (iii) reporting to relevant authorities where applicable.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information during registration and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.
5. Educational Content Disclaimer
All practice questions, explanations, study materials, and AI-generated content are provided for educational and test-preparation purposes only. The Service is not tutoring, academic counseling, official curriculum, or a substitute for accredited instruction. While we strive for accuracy and alignment with current TEKS standards:
- We do not guarantee that our content exactly mirrors the actual CBE exam questions, format, or difficulty. Practice and mock exams are independently authored and are not endorsed by, supplied by, or licensed from UT High School (UTHS), the University of Texas at Austin, the Texas Education Agency (TEA), or any state-recognized testing body.
- AI-powered explanations are generated by third-party large-language-model systems (currently Anthropic's Claude API). LLM output may contain factual errors, mathematical mistakes, outdated references, or hallucinations. You are solely responsible for verifying any AI-generated content before relying on it for academic decisions.
- We do not guarantee, promise, or warrant that using our Service will result in passing any CBE exam, earning any credit, achieving any specific score, gaining admission to any institution, or any other academic outcome. Outcomes depend on factors entirely outside our control.
- TEKS standards, CBE exam formats, scoring rules, retake policies, and cost are set by third parties (TEA, UTHS, individual school districts) and are subject to change at any time without notice to us. We make commercially reasonable efforts to keep content current but cannot guarantee parity with the most recent administration.
- Score reports, "weak-point" analyses, TEKS-mastery percentages, and pass/fail indicators within the Service are statistical estimates based on your performance on our practice items and have no official relationship to actual CBE results.
No professional advice. Nothing on the Service constitutes legal, financial, medical, educational counseling, or career advice. For decisions about course credit, graduation requirements, or college admissions, consult your school counselor or the relevant institution.
6. Payments and Refunds
Pricing. Subject access is sold per subject (currently $19.99 per subject, USD). Prices are displayed on the platform at the time of purchase and may change with reasonable notice for future purchases. Active purchases retain the price you paid.
Access Duration. Each paid purchase grants 180 days (6 months) of access from the purchase date for the specific subject purchased. Access is not lifetime. After expiration, access to that subject's paid features is automatically revoked. Each subject is sold separately; purchasing one subject does not grant access to any other subject.
Payment Processing. All payments are processed by Stripe, Inc. We never see, store, or log your card number, expiration date, CVV, or full billing address. We retain only Stripe-issued transaction IDs, the amount paid, and the purchase date.
No Auto-Renewal. Each purchase is a single, non-recurring charge — there is no subscription, no automatic renewal, and no recurring charge. After the 180-day access period ends, you may choose to make a new purchase at the then-current price to regain access. We will never charge your card again without a fresh, voluntary checkout. If we ever introduce a subscription product in the future, we will obtain separate explicit consent and provide cancellation tools as required by California's Auto-Renewal Law (Cal. Bus. & Prof. Code § 17602) and similar laws.
Refund Policy (7-day, ≤ 25% usage). If you are unsatisfied with your purchase, you may request a full refund by emailing [email protected] from the email address on the account, subject to both conditions below:
- The request is sent within seven (7) calendar days of the purchase date shown on your Stripe receipt; and
- You have answered twenty-five percent (25%) or fewer of the questions in the purchased subject's question pool, summed across all completed and in-progress mock-exam and practice sessions for that subject. (Example: if the subject has 200 active questions in our pool, you must have answered no more than 50 of them.)
Refunds are issued to the original payment method via Stripe within 5–10 business days of approval. Free sample questions and any access provided gratis are non-refundable. Refund requests for purchases beyond the seven-day window or beyond the 25% usage threshold will not be granted absent willful misconduct on our part.
Chargebacks. If you initiate a chargeback or dispute with your card issuer instead of contacting us first, we reserve the right to (a) suspend your account immediately, (b) revoke purchased access, and (c) charge a $25 chargeback-handling fee to recover Stripe's dispute fees. Please email us first; we will work in good faith to resolve any issue.
7. Intellectual Property
All content on the Service — including but not limited to questions, explanations, graphics, logos, software, and design — is the property of Texas CBE™ or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission.
8. Acceptable Use
You agree not to:
- Share, distribute, or resell exam questions or content from the platform.
- Use automated tools (bots, scrapers) to extract content from the Service.
- Share your account credentials with others or allow multiple users to access a single account.
- Attempt to reverse-engineer, decompile, or tamper with the platform's software.
- Use the Service for any purpose that is unlawful or prohibited by these terms.
- Upload or transmit viruses, malware, or any harmful content.
9. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. We comply with applicable data protection laws, including the Children's Online Privacy Protection Act (COPPA) for users under 13.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Texas CBE™, its owners, operators, employees, contractors, and affiliates (collectively, the "Texas CBE Parties") shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to lost profits, lost data, lost time, lost academic opportunity, lost tuition, missed deadlines, emotional distress, or reputational harm — arising from or related to:
- Your use of, inability to use, reliance on, or interpretation of the Service or any content within it.
- Any exam result, score, grade, credit determination, admissions outcome, or academic decision, whether made by you, a parent, an educator, or any third party, even if based in whole or in part on Service content.
- Any error, inaccuracy, omission, hallucination, mistranslation, or outdated information in content — including without limitation AI-generated explanations, TEKS mappings, TEKS category labels, "weak-point" reports, mock-exam scoring, blog articles, and FAQ answers.
- Service interruptions, outages, latency, scheduled maintenance, third-party API failures (including Stripe, Anthropic, and Google services), data loss, or technical failures of any kind.
- Unauthorized access to your account, password compromise, session hijacking, phishing, or credential stuffing — except to the extent caused by our willful misconduct or gross negligence.
- Conduct of other users, third-party links, or third-party content displayed within the Service.
- Changes to TEKS standards, CBE exam content, exam fees, retake policies, or other policies set by TEA, UTHS, school districts, or other third parties.
Aggregate cap. The total cumulative liability of the Texas CBE Parties to you, in the aggregate and across all claims of any kind, shall not exceed the greater of (a) the amount you actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Multiple claims do not enlarge this cap.
Essential basis. You acknowledge that the foregoing limitations are essential elements of the bargain between you and Texas CBE™ and that the Service would not be provided without them. The limitations apply even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. No Warranty
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, the Texas CBE Parties expressly disclaim all warranties including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, non-infringement, quiet enjoyment, system integration, freedom from viruses or harmful components, and any warranties arising from course of dealing or usage of trade.
We do not warrant that: (i) the Service will meet your requirements; (ii) the Service will be uninterrupted, timely, secure, or error-free; (iii) information obtained through the Service will be accurate or reliable; (iv) defects will be corrected; (v) any specific exam outcome will result from use of the Service; or (vi) AI-generated content is accurate. Reliance on Service content is at your own risk.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Texas CBE Parties from and against any and all third-party claims, demands, lawsuits, investigations, damages, losses, liabilities, settlements, judgments, costs, and expenses (including reasonable attorneys' fees, expert fees, and court costs) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third party's rights, including intellectual-property, privacy, or publicity rights; (d) any content you submit, transmit, or upload via the Service; (e) any misrepresentation regarding your geographic location or eligibility; or (f) any decision made by you, your parent or guardian, or any third party in reliance on Service content. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
13. Account Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these terms, engaged in fraudulent activity, or misused the platform. Upon termination, your access to purchased content may be revoked without refund for cause-based termination.
14. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved through binding arbitration in Travis County, Texas, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or participation in a class action.
15. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, internet or power failures, government actions, pandemics, or cyberattacks.
16. Severability
If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
17. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the Service after modifications are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
